Terms of sale

ARTICLE 1: PURPOSE

These General Terms and Conditions of Sale set out the performance arrangements and the conditions under which distance sales are concluded between MXPART and its customers. Our sales are subject to these General Terms and Conditions, which prevail over any other provision issued by the customer or MXPART, whether written or otherwise. These conditions apply to the items offered for sale in this catalogue. Product photographs are not contractually binding. Other offers may be ordered under specific conditions that will be communicated by MXPART.

ARTICLE 2: GOVERNING LAW

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, and if no amicable resolution can be reached, the French courts shall have sole jurisdiction.

ARTICLE 3: ORDERS

3.1 Acceptance

Placing an order implies the CONSUMER's full and unconditional acceptance of these General Terms and Conditions. Any contrary condition imposed by the CONSUMER shall be unenforceable. If items are unavailable, MXPART undertakes to refund the order or offer an item of equal or higher quality at an equal or lower price. If these items are unsuitable, they may be returned to MXPART, with return shipping paid by us where the withdrawal relates to an exchange (Article L. 121-20-3 of the French Consumer Code).

3.2 Legal capacity – Minors

The parties agree that minors who place an order act as agents of their parents.

3.3 Withdrawal period

The withdrawal period is 15 days from the date of payment. If this right is exercised, MXPART must refund the sums paid by the CONSUMER at no cost.

3.4 Payment methods

3.4.1 Payment by bank card

Payment is made through our secure interface. No banking information can be intercepted by a third party. MXPART does not retain any banking information entered during the ordering process. Your credit-card details are encrypted and are never transmitted unencrypted over the network.

3.4.5 Payment by bank transfer

Once your order has been confirmed, it will remain pending for 15 days without any product being reserved. MXPART's bank details will be available with your order so that you can make payment. The order will be confirmed upon receipt of your bank transfer.

ARTICLE 4: PRICES

The prices shown on the MXPART website are provided for information purposes and may be revised. The shipping cost will be displayed when the delivery method is selected.

4.1 France

The displayed prices include all taxes.

4.2 European Union

Customs charges are payable by the customer.

ARTICLE 6: TRANSPORT, DELIVERY, AND DELIVERY TIMES

6.1 Transport

If a parcel is damaged, the customer must refuse delivery. Accepting delivery constitutes acceptance of the goods in their delivered condition. If damage was not visible at the time of delivery, a claim must be made within 48 hours.

6.2 Delivery

Delivery will be made to the address provided by the customer. If an incorrect address results in the parcel being returned, the CONSUMER will be responsible for the cost of reshipping it. Delivery times are estimates and may vary.

6.3 Delivery times

Delivery times are provided for information purposes only. MXPART cannot commit to strict delivery deadlines, and no delay shall give rise to damages.

6.4 Force majeure

Events such as strikes or natural disasters may cause delivery delays. If such events continue for more than 15 days, the contract may be terminated without compensation.

ARTICLE 7: RETURN PROCEDURE

7.1 Mainland France and Corsica

MXPART offers the option of returning products within 30 days. Return shipping costs are payable by the customer. Returns must be sent using tracked Colissimo.

7.2 French overseas departments and territories and other countries

The return conditions are similar, but shipping costs remain payable by the customer.

7.3 Return conditions

Items must be returned in packaging other than the supplier's original carton and must not have been fitted or used.

ARTICLE 8: WARRANTIES

All products are covered by statutory warranties. In the event of a defect, a return request must be submitted to customer service.

ARTICLE 9: DATA PROTECTION

In accordance with French data-protection law, you have the right to access and rectify your data.

ARTICLE 10: PERSONAL DATA

MXPART collects data to process orders. This data is protected and used in accordance with the law.

ARTICLE 11: INTELLECTUAL PROPERTY

All elements of the MXPART website are protected by copyright. Any unauthorised use is prohibited.

ARTICLE 12: SEVERABILITY

If any provision is found to be invalid, this shall not affect the validity of the remaining provisions.

ARTICLE 13: DURATION

These conditions apply throughout the entire period during which MXPART provides its services.

ARTICLE 14: EVIDENCE, RETENTION, AND ARCHIVING OF TRANSACTIONS

Computerised records shall be regarded as evidence of transactions between the parties. Records are archived on a secure medium.

ARTICLE 15: CUSTOMISED PRODUCTS AND RETURNS IN THE EVENT OF NON-CONFORMITY

Customised products, including wheels configured to order, are excluded from the right of withdrawal in accordance with Article L221-28 of the French Consumer Code.

No refund or exchange is available unless there is a proven defect or clear non-conformity with the confirmed order.

If a product is non-conforming, MXPART may, after verification, send a replacement product. The customer will receive a prepaid return label to return the original product.

From the date on which this label is received, the customer undertakes to return the product within 7 calendar days.

If the product is not returned within this period without valid justification, the replacement product will be considered to have been purchased for consideration. An invoice equal to the value of the product sent will then be issued and will be payable immediately.

ARTICLE 16: CONSUMER MEDIATION

In accordance with Articles L.612-1 et seq. of the French Consumer Code, the customer may use a consumer mediator free of charge to seek an amicable resolution of a dispute.

After first submitting a written complaint to MXPART, and if no satisfactory response is received within 60 days, the customer may contact:
